Fire Risk Management and the 2021 Fire Safety Act: Taking Fire Risk Seriously in Accommodation Blocks

Fire Risk Assessments are a legal requirement under the Regulatory Reform Order (2005) and now the Fire Safety Act 2021.

Furthermore, in addition to being a legal requirement, Fire Risk Assessments, appropriate Fire Safety Measures and Fire Safety Plans are often required as part of a property’s pre-sale legal pack.

The Legislative Changes

The 2021 Fire Safety Act has been created to ‘ensure that people feel safe in their homes and a tragedy like the Grenfell Tower fire will never happen again.’

The legal changes introduced in this Bill mainly apply to multi-occupancy residential buildings – that is any premises that comprise of anything other than a single dwelling. This scope therefore covers a house converted into two apartments; this would now needs a risk assessment and appropriate fire safety measures – all the way up to high-rise buildings with multiple apartments and many residents.

Put simply, not only is managing fire risk a legal requirement, if there was a fire, then with fire risk management in place serious injury is less likely.

Although the law was passed in April this year, it’s unlikely that the Fire Safety Act will be brought into force until 2022. That said appropriate measures now, taking responsibility for tenant safety seriously this year, is the ‘right thing’ to do.

By putting Fire Risk Assessments into practice, this mitigates the risk of prosecution under the Fire Safety Act 2021. It can be presented that having completed a Fire Risk Assessment demonstrates and provides evidence that you have carried out all that is practicable to prevent and protect against fire in the first place.
