The Fire Safety Bill was introduced in March 2020 following the tragedy at the Grenfell Tower (in June 2017). The bill was made into law on 29th April 2021.
It is specific area concern is multi-dwelling residential buildings, crucially the external walls of the building and fire doors of individual flats must be assessed as part of the fire risk.
This could be relevant to:
- multi-dwelling apartment blocks
- student accommodation
- serviced accommodation
- residential blocks with common areas
- block management companies
The act is specific to England and Wales.
The specific legislation is quite specific in that it deems those in control of the premises ‘Responsible Persons’ they are now responsible for the fire safety of that building.
It is their duty to undertake fire risk assessments and manage associated risks. Furthermore, their duty is to reduce risk in addition to both assess and manage the fire risk. This includes the risk associated with the structure of the building, external walls and individual opening doors onto common / shared parts of the building.
The concept of ‘risk based guidance’ is introduced, and requires Responsible Persons to take proportionate approach to managing and assessing risk.
